I need some clarfication here more the anything..

If a tool says it is free for non-commercial use, how 'far' does non-commercial go?

Eg I used a tool with the above agreement for a 'rolling demo'/concept for a game. The tool will not be used in the final product or any other versions beyond the demo... would this be against the agreement?

If you profit from people buying your stuff, then its commercial. Try not to prance and dance around that fine line so you don't get any problems.

And you wonder why the legal "system" doesn't work. All the worthwhile laywers are where? Games!!! Who would've thought...

All software under true free software licenses such as GNU GPL is free for commercial use. DevKit Advance is a distribution of GCC, which is under GNU GPL.

However, if it's a library, that's slightly different. Linking a library into your program involves preparing a derivative work. Licenses for libraries tend to make stricter demands than licenses for tools. Some licenses for libraries require the developer of an application linked with the library to disclose the application's source code, which is not compatible with a business model based on restricting access to the source code.
