Is there currently a way of creating a listening server on the ds. I have created a game for the DS and I'd like to include multiplayer support but I would have to be able to start a server on one DS so that other people can connect to it and play together.

Yes it's possible. (In fact, DSFTP2.0 is a working example of it!)
You will have to open up the listening port in your firewall or NAT router, just like you would, on the PC.

And you have to have a sufficiently open access point. No, I can't give recommendations for battery-powered access points.

There is a solar powered ones (wireless access points) using the za1201 driver under linux or Zylus chip set under linux as well but all home built. These are being used by the scientific community for field data gathering.

Is it not yet possible to do it the same way nintendo does? two ds's only (or more) with no pc network already?

If you mean directly linking to consoles together over wireless without any AP, then no, I don't believe the WiFi lib supports that; neither using WiFi Ad-Hoc mode, or Nintendo's "NiFi".
