reall dont know i'm not sober wile rightin this so ingnore or insult me if you think it is a load of rubbish but all gsmes that created to high standard get wasted time when they don't and you dont know wether the idea is just worth developeing if you cant sell to sell if people would buy them like even if it was just the peple who look for roms to download they would be cheap and developers would get a income and also have some way to rate them selve

i've not talk much detail but if any1 thinks that nitendo would sue my balls off for not having a contract or licence/ something like that to sell replys to my drunken idea

it was a idea tht if you make games for the gba of that there are 600 memebes to this site on its own all making games and demos a shop to buy and sell the final product's the sueing part was about nintendo having a problem with something like that i will fully explain what idea i had when i get time

A: YES. Nintendo doesn't want to lose its position as the monopoly manufacturer of GBA Game Paks.

Q: Would Nintendo have any grounds to sue a homebrew publisher?

A: REPLY HAZY. Independently publishing a console game in the United States, including reproducing the header's logo data, has been ruled lawful in Sega v. Accolade (read the opinion), but 17 USC 1201(a) has been enacted since then, and Nintendo may be able to claim in court that the logo check is an "access control measure". It depends to a great extent on how the Lexmark case (Google News) goes.

Update: Lexmark lost. Now we have another precedent arguing for the legality of distribution of the 156-byte magic cookie in GBA programs.

I'm guessing that the Freelancer carts use some sort of bankswitching that the official carts don't use.

Freelancer carts use the logo from a commercial cart. That way the logo is never stored on the freelancer cart. It's the safe way of doing it, without risking any trouble from Nintendo.

I don't get it - why buy a freelancer cart if u have to use a commercial cart to get the header?

It's possible to use another logo, as long as it has the same CRC. There's two other that's possible.

thinking about it, now i understand what the whole piggybacking thing is about. i think ppl would be put off by that idea. i think they'd be better off either not doing this at all, or being prepared to go to court and cite sega vs accolade and, more recently, lexmark vs whoever it was.

basically, i think the practice of requiring copyrighted data in order to boot the system has proven unfavourable in the courts.

There is one very tricky problem with this... The Sega and Lexmark cases only assure that there will likely be no problem in the US.
It does not help thoose who live in the rest of the world.

But then again, the copyright related laws in the rest of the world generally make more sense than US copyright laws.

This bugs me.

I'm a software developer, and I've been playing games since my dad got a Coleco Telstar in '76, and a 2600 in '78. I've always wanted to have my name in a game on a console, but I'm in NO way inclined to be a game developer. It's something I'd like to do in my spare time. The only game I ever wrote was for the Atari 800 back in '84. That said, I've been toying with GBA programming the last few days and I have some ideas for games. I understand why game companies want to have authorized games on their systems, but I think that there's strong homebrew community for lots of platforms that put out quality products. A perfect example is the Xbox Media Center. There should be a way for Nintendo and other companies to allow homebrew users to publish games, or have a way for a publisher to pick the game up from a homebrew developer. Yes, I could develop it on the PC, but there's something special about writing a game for a console.

I hope this homebrew distribution system works out.

Update: Lexmark lost again. Slashdot reports that the court has denied Lexmark's request for a rehearing en banc.

And the Supreme Court has denied certiorari as well. This means Static Control Components has prevailed over Lexmark in the highest court in the United States. This is a win for homebrew developers of software for GBA and Nintendo DS.
